Woman Falls Getting Out of Rental Truck

Plaintiff, a pregnant female, sued Defendant-moving truck rental company after slipping on a step while exiting one of Defendant's moving truck. Plaintiff fell and landed on her back and buttocks, suffering multiple disc herniations in her cervical and lumbar spine. Plaintiff's unborn fetus was not harmed by the fall. Plaintiff alleged that the step was negligently polished and slippery. Defendant asserted that the step had not been polished at all. This case was tried as a bench trial. Evidence was shown to establish that some vehicle polish was used on the vehicle by an employee of Defendant.
