Acetaminophen MDL Plaintiffs’ Leadership Appointed

On November 16, 2022, in the Acetaminophen Multidistrict Litigation (“MDL”), U.S. District Judge Denise L. Cole of the Southern District of New York approved a Plaintiffs’ Leadership structure.

The following three attorneys will serve as plaintiffs’ co-lead counsel: Mikal Watts, Ashley Keller and Mark Lanier.

Dan Sullivan of Holwell Shuster & Goldberg will serve as Plaintiffs’ Liaison Counsel.

The Plaintiff’s Executive Committee will include the plaintiffs’ co-lead counsel, Watts, Keller and Lanier, plus Ashley Barriere from Keller Postman, Sean Tracey from Tracey Fox King & Walters, Eric Holland from the Holland Law Firm, Roger Smith from Beasley Allen, and Zoe Littlepage from Littlepage Booth Leckman.

Ten additional attorneys will serve on the Plaintiffs’ Steering Committee Membership: Julien Adams from Dovel & Luner, Tricia Campbell from Krause & Kinsman, Charles Cooper from Cooper Law Partners, Eric Cracken from TorHoerman Law, Paul Danziger from Danziger & De Llano, Richard Golomb from Golomb Spirt Grunfeld, Patrick Luff from Luff Law Firm, David Matthews from Matthews and Associates, Neal Moskow from Ury & Moskow, Rick Paul from Paul LLP, Ruth Rizkalla from The Carlson Law Firm, Lawrence Robbins from Friedman, Kaplan, Seiler & Adelman and Lindsey Scarcello from Wagstaff & Cartmell.

Earlier in the week on November 14, 2022, in a 28-page opinion, the judge denied defendant’s Motion to Dismiss for Preemption.

The case is In re Acetaminophen – ASD-ADHA Products Liability Litigation, case number 1:22-md-03042, in the U.S. District Court for the Southern District of New York.
